MIB warning to OTT platforms against publishing obscene, pornographic content

The Ministry of Information and Broadcasting (MIB) has issued an advisory urging OTT platforms to comply with regulations and avoid publishing obscene, pornographic, or vulgar content. This marks the second advisory within two months, following concerns from MPs, statutory bodies, and the public, notably after the controversy surrounding India’s Got Latent.

Referencing the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the advisory emphasizes the Code of Ethics, which mandates:

  • Prohibition of restricted content.
  • Age-based content classification.
  • Access controls for "A"-rated content.

OTT platforms must also comply with the Indecent Representation of Women Act, 1986; Bhartiya Nyay Sanhita (BNS), 2023; POCSO Act; and IT Act, 2000. Self-regulatory bodies are urged to ensure adherence to the Code of Ethics and address violations proactively.
