The Paris Prosecutor’s Office has launched an investigation into Philips regarding its large-scale recall of sleep apnea and respiratory devices. The probe, opened in June, includes charges of aggravated fraud involving goods harmful to human health and failure to report incidents that could result in death or serious health deterioration.
Philips recalled over 15 million devices globally in 2021 after discovering toxic soundproofing foam could release particles potentially causing inflammation, asthma, or carcinogenic effects. The Paris prosecutor’s public health division has received 104 complaints to date.
Philips stated the investigation is part of ongoing proceedings and does not pertain to products currently sold in France. The aggravated fraud charge carries fines up to €3.75 million for corporations. Philips has already paid a $1.1 billion U.S. settlement for personal injury and medical monitoring claims and faces additional enforcement actions in Australia.
