The Trump administration has introduced a proposed rule aimed at accelerating permits for major energy and infrastructure projects, including oil and gas pipelines and facilities supporting artificial intelligence. The proposal would revise procedures under Section 401 of the Clean Water Act, a provision that has traditionally empowered states and tribes to approve, condition, or deny federal permits for projects that could harm local waterways.
According to the Environmental Protection Agency, the changes are designed to streamline reviews by standardising application requirements, enforcing a strict one-year decision deadline, and preventing repeated resubmissions that extend timelines. Federal officials argue that the current system has been used to delay projects for reasons beyond water quality.
Environmental organisations and legal experts warn the rule would significantly narrow state and tribal oversight. Critics say limiting reviews to direct discharges could prevent regulators from addressing wider impacts on rivers, wetlands, and aquatic ecosystems. They also caution that the proposal, combined with recent court rulings, could weaken protections for smaller waterways. A public comment period will precede a final decision.
