EPA Authority to Tighten Pollution Rules Faces New Legal Challenge

Ethylene oxide was long viewed as a minor industrial pollutant, attracting little scrutiny. That perception changed in 2016, when the US Environmental Protection Agency (EPA) concluded the chemical was far more carcinogenic than previously believed. Years later, the agency introduced tougher rules, finalised in 2024, requiring chemical plants and commercial sterilisation facilities to sharply reduce emissions linked to cancers such as lymphoma and breast cancer.

Now, the EPA under President Donald Trump is reconsidering whether it has the legal authority to revise hazardous air pollution standards more than once when new scientific evidence emerges. Industry groups argue that once a rule has been updated, further risk-based revisions are not permitted under the Clean Air Act.

Environmental experts warn that accepting this view could severely limit the EPA’s ability to regulate nearly 200 toxic air pollutants, even when new data reveals greater health risks. Critics say such a move would undermine science-based regulation and public health protection.
