Kenyan court halts US health aid pact citing data privacy risks

A Kenyan High Court has temporarily suspended a $2.5 billion health aid agreement with the United States, citing concerns over the protection of citizens’ personal health data. The ruling follows a petition by a consumer rights group alleging the deal could enable the transfer or sharing of sensitive medical information, including epidemiological and personal health records. The court has barred authorities from implementing any provisions related to data sharing until the case is fully heard.

Health Minister Aden Duale said the government would respect the ruling but plans to challenge it, clarifying that only data-related sections are affected. While President William Ruto has sought to reassure the public that Kenyan data laws will prevail, critics warn the agreement could compromise control over health systems and digital infrastructure. The case will resume in February.
