India Orders Action Against Illegal Nicotine Pouch Sales

The Indian government has directed states to intensify action against the sale and distribution of nicotine pouches, citing concerns over their availability in the country and the potential health risks associated with nicotine exposure.

The direction was issued by the Ministry of Health and Family Welfare to state authorities. The ministry has asked officials to take appropriate enforcement measures against the manufacture, sale and distribution of nicotine pouches that are being marketed in India without the required regulatory approval.

Nicotine pouches are small oral products that contain nicotine but do not contain tobacco leaf. They are placed between the gum and lip, allowing nicotine to be absorbed through the tissues of the mouth. International brands have become increasingly visible in markets outside traditional tobacco products, including through online sales.

Indian authorities have expressed particular concern about the accessibility of these products to young people. The government has already prohibited electronic cigarettes in India, while certain nicotine-replacement products, such as nicotine patches and chewing gum, are permitted for approved medical uses.

The latest action follows recommendations concerning the regulatory status of newer nicotine formulations. The Drugs Technical Advisory Board has recommended that no new nicotine formulations be approved, citing public-interest considerations.

Government authorities have also raised concerns about the sale of nicotine pouches through both online and physical retail channels. States have been asked to examine such sales and take action under the applicable legal provisions.

The move comes amid wider efforts to strengthen control over products containing nicotine and to prevent the unauthorised marketing of formulations that have not received regulatory approval.

The Health Ministry's directive places responsibility on state enforcement authorities to identify illegal sales and take appropriate action in accordance with existing laws and regulations governing drugs and nicotine-containing products.
